General Terms and Conditions of Brenda & Andrew Boutique

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

  • Withdrawal period: the period during which the consumer can exercise their right of withdrawal.

  • Consumer: the natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur.

  • Day: calendar day.

  • Continuous transaction: a distance contract concerning a series of products and/or services, the supply and/or purchase obligation of which is spread over time.

  • Durable medium: any means that allows the consumer or entrepreneur to store information that is addressed to them personally in a way that enables future consultation and unaltered reproduction of the stored information.

  • Right of withdrawal: the option for the consumer to withdraw from the distance contract within the withdrawal period.

  • Entrepreneur: the natural or legal person who offers products and/or services to consumers at a distance.

  • Distance contract: a contract in which, within the framework of a system organized by the entrepreneur for the distance selling of products and/or services, exclusively one or more techniques for distance communication up to and including the conclusion of the contract are used.

  • Technology for distance communication: means that can be used for concluding a contract without the consumer and entrepreneur being simultaneously in the same place.

  • General Terms and Conditions: these General Terms and Conditions of the entrepreneur.

Article 2 – Identity of the Entrepreneur

We believe in transparency and will provide all necessary business registration information upon request, in line with applicable legal requirements and to ensure customer confidence.

Article 3 – Applicability

These General Terms and Conditions apply to any offer from the entrepreneur and to any distance contract and orders concluded between Brenda & Andrew Boutique and the consumer. Before the contract is finalized, these General Terms and Conditions will be made available. If this is not reasonably possible, it will be indicated that the terms can be viewed electronically and will be sent free of charge upon request.

If one or more provisions are found to be legally invalid or void, the remaining provisions shall remain in force. The invalid provision will be replaced in mutual agreement with one that matches the original intent as closely as possible.

Article 4 – The Offer

Time-limited or condition-based offers will be explicitly stated.

Offers are non-binding; Brenda & Andrew Boutique may change or withdraw an offer at any time.

Descriptions of products and/or services will be as accurate as possible. Product images are for illustration purposes only and may differ slightly in color or style due to screen settings or lighting.

Offers include clear information regarding:

  • Pricing (excluding duties, VAT, or applicable taxes)

  • Any applicable shipping charges

  • How the contract is concluded

  • Whether the right of withdrawal applies

  • Accepted payment and delivery methods

  • Offer validity duration

  • Conditions regarding recurring purchases, if any

Article 5 – The Contract

The contract is concluded when the consumer accepts the offer and meets all conditions. If acceptance is confirmed electronically, the consumer may cancel until confirmation has been received.

Article 6 – Right of Withdrawal

Consumers may return non-sale items within 14 days of receipt, without giving a reason. Items must be returned in original condition and packaging.

Article 7 – Costs in Case of Withdrawal

Consumers are responsible for return shipping costs. Brenda & Andrew Boutique will refund the original purchase price, including the original shipping fee (if applicable), within 14 days after receiving the returned item or a valid proof of return.

Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal is excluded for:

  • Items that cannot be returned for hygiene reasons (e.g., earrings, lingerie, bodysuits, etc.)

Article 9 – The Price

All product prices remain valid for the period specified in the offer. Brenda & Andrew Boutique reserves the right to adjust pricing based on regulatory changes, currency shifts, or clerical errors.

Article 10 – Compliance and Warranty

Brenda & Andrew Boutique guarantees that its products and/or services meet the reasonable standards of usability, quality, and durability, in line with the contract and applicable Canadian consumer protection laws.

Article 11 – Delivery and Execution

Orders are fulfilled with the utmost care. In the event of delays or product unavailability, the consumer will be notified as soon as possible.

Article 12 – Payment Methods

Unless otherwise agreed, payment is required at the time of purchase. All transactions made through www.brenda-andrew.com are subject to these Terms of Service, including details on pricing, taxes, and shipping. Brenda & Andrew Boutique reserves the right to correct any errors in product information or availability at any time without prior notice.

Article 13 – Complaints

All complaints must be submitted in writing via email to support@brenda-andrew.com. We aim to resolve all issues promptly and fairly in accordance with Canadian consumer protection laws.

Article 14 – Applicable Law

Brenda & Andrew Boutique is a Canada-based online store. All agreements and transactions are governed by the laws of Canada, unless consumer protection laws in the customer's country or province provide otherwise. These Terms do not override your statutory rights under Canadian federal or provincial law or international consumer protection legislation where applicable.

Article 15 – Amendments to the General Terms and Conditions

Brenda & Andrew Boutique may amend these terms at any time. Changes will be communicated at least 30 days before taking effect, where legally required.

Article 16 – Shipping and Return Locations

Orders may be fulfilled from warehouses in Canada, the United States, or Asia, depending on stock availability. Return shipments must be sent to the address provided with your return approval, which may vary by item origin.

Article 17 – What We Mean by ‘Verified Boutique’

When we refer to Brenda & Andrew Boutique as a ‘Verified Boutique’, we mean that our store is officially verified on platforms such as Meta (Facebook/Instagram Shop), Shopify, Pinterest, and Google.

In addition, we are positively reviewed on platforms like Trustpilot and Loox, where verified customers share real shopping experiences. These verifications reflect our commitment to trust, quality, and customer service.

Article 18 – Legal Disclaimer

Brenda & Andrew Boutique reserves the right to change its return, exchange, or promotional policies without prior notice.

These terms do not exclude or limit your rights under applicable consumer laws in your region, including (but not limited to) Canada, the United States, and the European Union.

While we strive for accuracy in all listings, please note:

  • Colors and sizing may vary slightly due to lighting, monitor settings, or manufacturing tolerances.
